3. Counter-Notification Procedure

If material you posted on bestmoldtestingusa.com was removed or disabled due to a DMCA notice, and you believe this action was taken as a result of mistake or misidentification, you may submit a counter-notification (pursuant to 17 U.S.C. § 512(g)(3)).

Your counter-notice must be in writing and sent to matt@bestmoldtestingusa.com containing the following elements:

  1. Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or disabled.

  2. A statement under penalty of perjury:

  3. Your name, address, telephone number, and email address.

  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, for any judicial district in which the Website may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the copyright owner does not file a court action seeking a court order within 10–14 business days of receiving the counter-notice, we may restore the removed material at our discretion.
